Klassics by Kurtis, Inc. Terms, conditions and other agreements

When you place an order on klassicsbykurtis.com, you are agreeing to the following terms and conditions:

Product information and in-stock availability:  Klassics by Kurtis, Inc. and our suppliers try to anticipate our customer quantity requirements; however, sometimes we underestimate or conditions might prevent us from receiving or placing a reorder. Klassics by Kurtis, Inc. will refund the amount paid on any item that is not in stock at the time of ordering; Klassics by Kurtis, Inc. may or may not offer to back-order merchandise instead of a refund.  Please keep in mind that color(s) might be different due to the type of hardware/software configurations you have and will not be considered to be an error of klassicsbykurtis.com.  There may be times when  descriptions, photos and illustrations were created in advance of receiving the merchandise and some merchandise might not be exactly as pictured due to a manufacturer's change; however, the quality will be same or better than what was described or shown

  • Return and Company Policies subject to change without prior notice. Customer should review these policies prior to making a purchase.  All returns of merchandise must have a RMA (Return Merchandise Authorization)  To receive a RMA customer must call Klassics by Kurtis, Inc. within 10 business days of delivery.  All returns of merchandise (with a RMA) within ten business days of delivery that is not opened and is not defective will be elegible for a full refund minus 20% (twenty-percent) restock/handling fee.  Customer is responsible for all return shipping charges.  Defective merchandise that is returned according to Klassics by Kurtis, Inc. terms and conditions will not be charged a 20% (twenty-percent) restock/handling fee, however the customer is responsible for all return shipping charges.  If customer returns a defective item, customer may choose to replace it with the same item or in the event the item is not available customer may choose to replace the item with like merchandise.
  • Returns and Exchanges: Damaged merchandise must be reported to Klassics by Kurtis, Inc. within ten business days after shipment.  Klassics by Kurtis, may (or) may not ask for pictures of the damaged merchandise to be E-mailed prior to issuing a RMA.  Klassics by Kurtis, Inc. reserves the right to refuse a RMA or to issue only one RMA per returned product.  If it is determined by Klassics by Kurtis, Inc. that the damage is due to the shipping carrier, a claim must be made by the Customer with the shipping carrier.  Klassics by Kurtis, Inc. is not responsible for return shipping.  If Klassics by Kurtis, Inc. issues a RMA, once the damaged item is received, Klassics by Kurtis, Inc. will either replace the item(s), with like merchandise, offer comparable merchandise or issue a refund.  Klassics by Kurtis, Inc. does not pay shipping on replacement RMA's in the event that a replacement RMA is issued. 
  • Product pricing information: Due to the nature of the internet, from time to time third party web sites, such as internet search engines, and product shopping sites, bots and "spiders" will scan our site with or without our knowledge or permission. The prices that are scanned might not be the most up to date.
  • Klassics by Kurtis, Inc. reserves the right to limit quantities of any item; we also reserve the right to cancel or refuse any order submitted to us for any reason.
  • Credits, adjustments and refunds:  We will refund or credit you by the same method that you have paid us. Credit card transactions must be credited back to the same credit card. If you have paid with a check or money order, then we will issue a company check.
    Please allow 7 to 10 business days for the credit to show up on your credit card statement after we receive the returned merchandise and we processed the credit.  Processing time usually takes 7 to 10 business days after we receive the returned merchandise.
    If you are receiving a company check refund, please allow us 7 to 10 business days to process your draft and it will be valid for 30 days.
  • Additional Shipping Information: Klassics by Kurtis, Inc. does not promise or guarantee a delivery date, as we do not have control of a package once it leaves our warehouse. Our current shipping rates are listed when you check out; no other shipping rates are valid or promised.
  • Orders lost while in shipping:  Your order will ship via FedEx or U.S.P.S., the first $100.00 of the order with FedEx is insured.  If an order is lost, contact customer service and we will file a tracer with the carrier.   This process can take up to 14 to 20 business days with the carrier.  A credit will be issued after that time frame has lapsed (at Klassics by Kurtis, Inc. discretion)   Orders shipped by any other method (including United States Postal Service, U.S.P.S.) are shipped at customer's own risk, as ownership of the merchandise transfers over to the customer, once the carrier has accepted the parcel.
  • Shipping and Ordering Processing Information: Most of our shipments are processed and shipped within 3-5 business days. Keep in mind that a business day is a non-holiday, weekday. We do not ship or process orders over the weekends. Order processing times that are posted are approximate and are not firm. During peak season (November, December), order processing and delivery times might be delayed.
  • Rush or Time Sensitive Orders: If you have a rush order for a special occasion, please let us know in the notes section of your order. We will try, but cannot promise to rush your order out.
  • Order Cancellation or Change: Once your order has been submitted to us and approved, your order will be sent to the warehouse for processing. Once your order has been submitted to the warehouse, we cannot cancel or change the order. We will attempt to cancel or change the order; however, no guarantees are provided. Orders that are returned due to incorrect address will be subject to a 20% restock and processing fee. If your order is a special order or request, customized, or personalized, the order cannot be cancelled or changed once placed to Klassics by Kurtis, Inc. for processing.
  • klassicsbykurtis.com and The Klassics by Kurtis, Inc. Company, will not be responsible or held liable for any incidental or consequential damages arising from the use or misuse of any product(s) it sells including products with a net total cost of $0.00.
  • Klassics by Kurtis, Inc. strives to be as accurate as possible in our content and pricing. In the event a product is listed with an error in pricing or incorrect content, Klassics by Kurtis, Inc. shall have the right to refuse or cancel any order whether or not the order has been confirmed and credit card charged. In the event that a credit card has already been charged and an order subsequently cancelled, Klassics by Kurtis, Inc. will issue a refund to the credit card account in the amount of the charge. Klassics by Kurtis, Inc. strives to make sure the content and descriptions of the products are accurate. However, Klassics by Kurtis, Inc. is not responsible for typographical errors; product description or content errors. You have ten days after receiving the item to notify us of any error in the order received.

  • Legal information:

    Klassics by Kurtis, Inc., klassicsbykurtis.com, Klassics by Kurtis, KBK, are referred to as The Company.  Buyer is referred to as YOU or CUSTOMER.

    Choice of Law:

    For all purposes, this Agreement shall be deemed to have been made within the State of Michigan. This Agreement shall be governed by the laws of the United States of America and the laws of the State of Michigan, without regard to Michigan choice of law and conflicts of law rules, and Klassics by Kurtis, Inc. and YOU each submit to the exclusive jurisdiction of the Circuit Court of Oakland County, Michigan, or to the question arise under Federal law or federal jurisdiction based upon diversity of citizenship.

    Force Majeure:

    Klassics by Kurtis, Inc. shall not be liable or deemed to be in default for any delay or failure in performance under this Agreement or interruption of service resulting directly or indirectly from acts of God, civil or military authority, acts of public enemy, war, riots, civil disturbances, insurrections, accidents, fire, explosions, earthquakes, floods, the elements, strikes, labor disputes, shortages of suitable parts, materials, labor or transportation, magnetic interference, interruptions of electrical power or other utility service, unavailability of any telecommunications service or connection to any telecommunications service, delay due to U.S. Customs, breakage or any other damage to merchandise in transit or any cause beyond the reasonable control of Klassics by Kurtis, Inc.

    Klassics by Kurtis, Inc. reserves the right to limit quantities and to correct any typographical or pricing errors. Conditions of our company policies are subject to change without notice. This page is our most current company terms.
